ASEAN consists of ten member states with four newcomers Cambodia, Laos, Myanmar and Vietnam (CLMV) . The reign differs from democracy to military authoritarian states. Members of ASEAN agreed to form the community with non-intervention rules. Compare to European union which was under supra-national administration, ASEAN uses intergovernmental approach instead. Hence, the commitment to the international rules between member states is different than the EU. While EU has European commission to issue regulations and directives, ASEAN in the other hands, has no such mechanism but cooperating through informal understandings that impose no legally binding obligations. Without the supra-national organization issuing orders, the integration process may be difficult, this apply to legal affairs as well.
The next post will be about ASEAN's member legal system overview, I might not post them in consecutive order but there will be other things in between the entries as the change of pace. See you next time.
